Since October 2024, every UK employer has had an increased legal duty to actively prevent sexual harassment in the workplace. Yet nearly a year on, it’s still unclear how many businesses have genuinely changed their approach.

The law recognises how important it is for employers to lead the change. Sexual harassment is a serious workplace issue, a cultural risk and a legal liability.
The Equality and Human Rights Commission Technical Guidance (2024) makes it clear that organisations must take reasonable steps to prevent harassment, or risk being held vicariously liable. The Worker Protection Act 2023 (Amendment of Equality Act 2010) came into force in October 2024 and has raised the bar: it is no longer enough to simply react to complaints. Employers must actively prevent them.
